In 2023, the Cape of Good Hope SPCA executed a search and seizure warrant at Eagle Encounters, a former wildlife facility located on the outskirts of Cape Town, following repeated denial of access by the staff and owners. This inspection, under a warrant issued by the Stellenbosch Magistrates’ Court, uncovered disturbing scenes of animal cruelty. The SPCA seized animals in distress and opened criminal charges against the facility for contraventions of the Animals Protection Act 71 of 1962.

In a retaliatory move, Eagle Encounters launched an application in the Western Cape High Court to challenge the legality of the SPCA’s search and seizure warrant. Their founding affidavit alleged, among other things, that the warrant was unlawfully obtained and that the Magistrate who granted it had not properly applied her mind.
The SPCA, represented by Kellerman Joubert Heyns attorneys, opposed the application and filed a comprehensive Answering Affidavit, thoroughly refuting all allegations and outlining the legal basis and urgency under which the warrant was granted. Despite having ample time to respond, Eagle Encounters failed to file a Replying Affidavit and failed to do anything to advance the matter to a hearing.
SPCA Presses Forward
With the pending High Court case against the SPCA, blocking progress in the criminal prosecution, the SPCA took proactive steps last year to enrol the matter for hearing, and the matter was set down for 1 September 2025 in the Western Cape High Court.
In response, almost a year later, Eagle Encounters’ legal team sought to delay proceedings, arguing they had insufficient time to reply – despite the lapse of nearly two years since their initial application. The SPCA strongly objected, asserting that delay tactics would not be tolerated and that justice for the animals harmed remained our top priority.
Victory for Justice: Case Withdrawn
In a significant development, the SPCA has now received formal notice that Eagle Encounters has withdrawn its High Court application, and has tendered to pay wasted legal costs incurred by the SPCA in opposing the matter.
This is a clear victory for animal welfare, legal accountability, and the mandate of the Cape of Good Hope SPCA.
Facility Closed, But the Fight Continues
In 2024, Eagle Encounters officially closed its doors. While the facility’s closure is welcomed, the SPCA remains resolute in pursuing criminal prosecution for the abuse uncovered during the 2023 raid.
