The Cape of Good Hope SPCA has secured another successful prosecution in a case of animal cruelty. Mr David Jonathan Carelse (62) of Heideveld pleaded guilty to charges brought against him in terms of the Animals Protection Act 71 of 1962 after multiple inspections revealed his continued failure to provide for the welfare of his dogs.
Despite being issued with multiple warnings and repeated follow-up inspections over the course of several weeks, Mr Carelse failed to comply with the instructions issued by the SPCA. He failed to provide adequate food, veterinary care, or proper shelter, and he continued to keep the animals in inhumane conditions. A warrant was obtained, and on 5 December 2023, the dogs were seized from the property with the assistance of the South African Police Service.
” I tried by all means to educate Mr Carelse“, says Inspector Jeffery Mfini, “but he continued to fail those dogs every single day. I will never understand how someone can ignore animal suffering, especially when they know better“.
Following his arrest and prosecution, Mr Carelse was sentenced to a fine of R2,000 or two months’ imprisonment, suspended for three years. In addition, the court imposed a three-year ban prohibiting him from owning or having custody of any animals.
This conviction reinforces our message that animal cruelty is a criminal offence, and offenders will be held accountable,” says Chief Inspector Jaco Pieterse of the Cape of Good Hope SPCA. “The courts are recognising the seriousness of these crimes, and that sends a powerful warning to anyone who neglects or abuses an animal. Our Inspectors work tirelessly to uphold the law, and we will relentlesy pursue justice for animals no matter how long it takes to secure a conviction.”
